Article IX section 7 of the NC Constitution.

Sec. 7. County school fund; State fund for certain moneys.

(a) Except as provided in subsection (b) of this section, all moneys, stocks, bonds, and other property belonging to a county school fund, and the clear proceeds of all penalties and forfeitures and of all fines collected in the several counties for any breach of the penal laws of the State, shall belong to and remain in the several counties, and shall be faithfully appropriated and used exclusively for maintaining free public schools.

(b) The General Assembly may place in a State fund the clear proceeds of all civil penalties, forfeitures, and fines which are collected by State agencies and which belong to the public schools pursuant to subsection (a) of this section. Moneys in such State fund shall be faithfully appropriated by the General Assembly, on a per pupil basis, to the counties, to be used exclusively for maintaining free public schools. (2003‑423, s.1.)

Joseph T, I have been told that he court that these fines are imposed in is the town court, Have I been misinformed? Also. if this money goes to the county why do the town police work so hard to give out tickets?

Municipal/Mayors courts were abolished probably 40 +/- years ago. The police are sworn to enforce the laws of the state and the ordinances of the jurisdiction having charge. Pressure from the citizens on the commissioners cause pressure on the LEO's to enforce them. Plain, sweet, and simple

All the new stop signs and speed limits are for the raising of revenue and to inconvenience drivers enough that hey will go a differnt route. Those stop signs, unnessecary though they may be, will cost a driver $260 to just "roll thru."

The problem that I see is that no matter which way you go there is no easy quick way to get from 18N to 421 Business. I have followed cars that go various ways and we all end up on Business 421 about the same time. That being said, just go the way you want. If the powers that be don't like it then they can close the streets and deal with the residents on that.
The town doesn't make any money off of any court fines. Under the NC constitution the money from any fines go to the school system in the county in which the offense happen. The court cost part of it goes to the courts. Like I posted before if you want to fight these signs check the mutcd manual to see if they were legally put up if they weren't you can beat the ticket and can force the town or who ever put them up to take them down

The stop signs increase the noise a lot through there. Stopping and starting is loud.

"Rollercoaster Hill" makes it a little hard to stay below 25, especially coming up the hill if you drive a stick. The only way I can stay at 25 is if I'm in 2nd gear, but then I'm well over 3,000 RPMs.

I think that it's not legally considered a residential area, based on the distance between driveways or something. It should be a 35 zone, not 25. That's based on what I was told by the aforementioned in-the-know guy, though, so I can't back that up.

I was once told by someone that should know that the speed limits in the area weren't legal, either. There's no legal justification for it to be a 25 mph zone, so if you got a speeding ticket you could easily have it thrown out by the DA.

It would be interesting to hear if anyone has actually gotten a ticket for speeding through the area or running one of these stop signs.

The stop sign on Trogdon is silly, too. I go through there about every day and it is RARE that a car approaches the intersection from Trogdon Avenue.

The rest of the time, the rest of us just pull to a stop, look silly, and then continue on our way.

I don't think you can just willy nilly block a street....unless there is road construction or tree trimming, etc.

If they block the street off , then what ? People have been using the public streets in town for many, many years.

Town citizens pay for Town Streets such as Finley Ave. State taxes pay to maintain State Highways that run through the towns such as Hwy 18. 2nd Street is paid for by state taxes because it is also a state highway. (Hwy 18/Hwy 268). Finley, Trogdon, Hinshaw just to name a few are maintained and paid for with town taxes. The Town Council could vote and block off these streets if they wish, the state has no say so over them.

Actually, the section being discussed is not a part of Finley Park. There's no way to get to town via Finley Park.

The Elkin-Jonesville area is people friendly, I recommend staying out of " our town" , which was created for a certain few.


I thought the state maintained the "city" streets, I must be wrong.
