There is no constitutional right to operate a motor vehicle on a public highway. A right to travel most definitely. Yo u can walk, ride a bicycle or a mule for that matter. But being required to have a drivers license,tags and be sober is not a infringement on any one rights. Unless you are one of those sovereign citizen nut jobs.

@Pollock, it actually just happened about a week ago! A cop rear-ended someone in Rock Creek and flipped her car.

Actually in this incident the officer was responding with lights and sirens to a possible armed robbery call, other drivers stopped and remained stopped but the lady turned left in front of the officer causing the accident, she was found at fault by the NC SHP.

I think traffic checks are great, Get the people with no licenses and crooked tags and no insurance off the road, And the drugs they find is another plus. If taking 5 mins to show my license is the price for safer highways its well worth it.

I don't know why the question of the chase is even in the discussion. If the HP hadn't of went after them and Whitt killed someone down the road, then this would be a bash the SHP conversation because they didn't protect the public. I can't understand why "not chasing them" would even be considered. As well, it is still a question of how many lives were endangered by running. It's not like the perps would get a half mile down the road, see no one was behind them and reduce their speed. They would be running 100mph until they got to Statesville.


Maybe that's why felony speeding to elude arrest is a Class H felony.

Not really sure, yet back in the day Road Checks were considered entrapment? As of today & yrs prior they have them around the clock... It's all about the ****. If they give you a citation for no D/L you're free to go still driving?? What's up with that??

Yeah, hangs, I saw that last night. And it does say that the police have the right to pull them over for evading a traffic stop. But it doesn't say that it's a punishable offense by itself.

It doesn't matter, though, because running from them afterward AND that chase causing an accident became a felony. It's still debatable as to whether his running caused the accident (I think the law was thinking about them running people off the road or something), but that's a matter for his attorney.

Considering the Blue Shield, though, the kid will be lucky to not get the death penalty.

If some dies as a result of a felony being committed, no matter the intent, the person committing the felony may be charged with murder.

@hangsleft, that's true, but I can't find where evading a traffic stop is even illegal. However, you guys are right that the subsequent actions became a felony:


I still don't really agree with the law, because it's not his fault that the trooper made a mistake. And like Affy said, in the opposite situation the police get a free pass. But it is what it is.
