If anyone came on my property as a threat, I'd set up like a bomb shelter or fort and shoot my enemy with paintballs repeatedly to show my love.

A loaded shotgun can be taken away from you and used against you. People on here are offering help please protect and think of your family first. I know you are scared but please tell me he at least went to jail?!

Candy you are right that piece of paper wont protect her but it will help her legally if she had to defend her self and someone gets hurt or killed.
If it was me I would copy the GS from the link I provided below and go see the magistrate and request the order as listed under 50B-2. I would also take a few people who aren't involved as witnesses just in case he refused to issue the order. That way if some were to happen she could prove that she applied for one.
I would also record the conversation on my Phone or a Digital voice recorder.
Nurse I would suggest that you read NCGS 14-51.2 and 14-51.3 concerning self defense of your self or another.

Elmo, At this moment we are sleeping in shifts with a loaded shotgun nearby. Wilkes County Sheriff's Dept would not arrest him for arson. Yes, I said arson. It is serious but no one in law enforcement cares that he set the well house on fire and screamed "I'm gonna burn you outta this neighborhood dyke" and other drunken slurs while standing there watching it burn.

OP before you can get this restraining order accomplished, are you in need of assistance at the moment?

...but clearly, she did see the magistrate, according to her 9:58 post. So she isn't relying on GW advice. Since the magistrate refused to give her a restraining order, and not many law offices are open on Sunday, I'd say any advice would be welcomed.

Back to the restraining order. Why so important? It is just a piece of paper. I would be taking other means, and I hope you are, to keep your family safe. That piece of paper can wait. Family cannot. Paper will not protect you as I have the scars to prove. Protect yourself and the ones you love first then think about that worthless paper.

That piece of paper isn't going to protect you. You may want one just to say you had it though. I would have a backup plan in place. And know how to use it.

So... The magistrate told us that restraining orders are done in the clerk of court's office Monday-Friday, 8:00 - 5:00. This was far from a squabble, but I'm actually not surprised by the inaction of the Wilkes County Sheriff's Office.

Magistrates can order emergency protective orders if the elements are met that it can't reasonably wait until court opens on Monday. If it's just a "squabble" as listed below, then may have to wait until Tomorrow.

The sheriff's department has been out here already this morning. So I go to the magistrate's office at the courthouse and request a restraining order?

You should be able to get a restraining order any time. Go to the sheriff department, If you feel that you are in danger you must act as soon as you can. If it is just a squabble you know it. Law enforcement is 24 hours.

Can a restraining order be requested on a Sunday, or do I have to wait until Monday? How do I go about this?
