Areas of Emergency and Riot It is also a misdemeanor under North Carolina law for a person to transport or possess, off his or her own premises, a dangerous weapon in an area during a declared state of emergency, or in the vicinity of a riot. N.C. Gen. Stat. � 14-288.7 A concealed handgun permit does not allow a permittee to carry a weapon in these areas. N.C. Gen. Stat. � 14-415.11(c)

We need to to get started on a fix to that. One of the prohibited places in the CCW statue is At any parade or demonstration, but it says nothing in the course about (A state of Emergency)

He, she, it, doesn't matter. Kudos to 'it' for not enforcing it by writing tickets, and instead assisting the folks who were out anyway to get where they were going.

And that means - when there has been a state of emergency declared, and they tell you to keep your *** at home and off the roads, then keep your *** at home and off the roads. It specifically states you are allowed to carry/whatever on your own premises.

The first link posted has a quote from the relevant code: 14‑288.7. Transporting dangerous weapon or substance during emergency; possessing off premises; exceptions. (a) Except as otherwise provided in this section, it is unlawful for any person to transport or possess off his own premises any dangerous weapon or substance in any area: (1) In which a declared state of emergency exists; or (2) Within the immediate vicinity of which a riot is occurring. (b) This section does not apply to persons exempted from the provisions of G.S. 14‑269 with respect to any activities lawfully engaged in while carrying out their duties. (c) Any person who violates any provision of this section is guilty of a Class 1 misdemeanor. (1969, c. 869, s. 1; 1993, c. 539, s. 192; 1994, Ex. Sess., c. 24, s. 14(c).)

This is the same sort of crap they pulled post Katrina, In a state of emergency is when most citizens feel the greatest need for personal protection. The city is looking for a lawsuit. As a concealed carry permit holder,and instructor I am aware of no statue that limits lawful carry during emergency. We need to get a bill introduced that will stop this nonsense,14 other states including Louisiana already have. Also some of the home and business owners in the Big Sleazy have still not recovered their firearms despite a court order to the effect. As a old friend of mine said ( When they come for your guns let em have the bullets first!)

The King Police Chief didn't declare anything, other than to not write tickets and to not enforce the action. Give the guy a break. It states clearly that it was the city council that declared a state of emergency. And the ban? Thats a state law, not a local King or even Stokes county law. It could just as easily happen here the very same way.
Thank the Chief for being understanding of something he didn't have power to undeclare - he did the next best thing - no enforcement.

During the last ice storm in King NC, The police chief declared a State of Emergency with a curfew. No alcohol, guns or amunition could be sold. Also you could not posess a gun except on your own property. The same thing happened during Katrina. If I lived in King, I would be fighting mad. Looks to me like during times of SOE, is the times when law abiding citizens need their guns the most.
