While an employer may not compel an employee to take leave because she is pregnant as long as she is able to perform her job, it�must allow women with physical limitations resulting from pregnancy to take leave on the same terms and conditions (e.g., provide them with the same amount of leave) as others who are�similar in their ability or inability to work."
notice the words may not before the word compel.

Crypt, You are correct regarding the light-duty requirements, if WalMart offers such a program to anyone. Thanks for the links, I'm not sure how the first link is relevent since it is dealing with abortion benefits under an insurance plan, but the second link was very helpful and expanded my understanding of the EEOC's reach.

That depends on how you define "small business," Crypt. The law only applies to businesses with more than 15 employees, which I don't really consider a small business.

Crypt Light duty is not a "right" in the employment laws, light duty is an optional measure many employees use to return workers comp injuries to work vs. sitting at home collecting a check. Pregnancy is a temporary disability, if the correct processes are followed the employee may claim an accommodation for that temporary disability. Different animal all together and much more difficult to accomplish.

Emphasis on "technically." If she makes a fuss, they can always come up with some other reason to fire her, and then she won't get maternity leave at all.

It's not unheard of for a manager to forge complaints and write-ups if they think they're going to get caught. Unless you can prove that they're forged, making a fuss could cause bigger long term problems than you want.

Besides, Wal*mart is sued an average of once every 2 hours (with many of them being for discrimination against women), so the best you could hope for is to join a class action suit that might get resolved in this lifetime -

You state that she can perform her job duties, have you seen or read the actual job description? I'd imagine that there are quite a few things in the JD which are not being performed now, but which would be a hazard for a pregnant women. WalMart has been at this for a long time, I doubt this is a single store decision.

The EEOC (equal opportunity employment commission) takes precedence over and is the Daddy over any republican "slave driver boss" in this state. Call the Feds.

That's bull,I worked up until the very end pregnant with all 3 of mine,unless their is a new law I don't know about she can work until the end if she chooses too!

This is North Carolina, so she should be grateful that they're giving her maternity leave. They could just fire her for no reason, and there aren't any laws to prevent it.

Heck.. I worked up until the day before I gave birth! Which was a Friday. Was off on Saturday anyway... No problems.
We just had a girl work up until a few days before giving birth to healthy twin babies! We're pregnant... Not broken!
Smh.... Best of luck to her! I say let her work! By golly. Smh...
