The judge was dead wrong in his decision. This judge is usually a magistrate so I would go to the superior court judge and file a complaint.

Dog it has been more than 20 years since this happen, so I don't remember all the details, but I am pretty sure it did end up in court after the magistrate refuse to force the eviction. My friend had to Goto court several times over the issue and I agree that the judge was wrong.

Renters need to do what they are told or gtfo

Once the lease is signed it doesn't quite work like that. Renter and landlords have rights set out in both federal and state law and in some places counties and towns also add to these.

Its not but in my friend case the judge said he wasn't going to put the person out on the street and kept giving him time to find somewhere to go.

You don't get it evictions have to be approve by the courts and you're not just going to be able to evict someone who is paid up on rent and breaking no laws. Also retaliation against a tenant by a landlord is against the law and will open the landlord to bigger legal problems.



I had a friend who rented apartments in Boone and tried to evict a guy for nonpayment. The non-paying tenant told the judge he was broke and had nowhere to go and the judge refuse to enforce the eviction. The guy ended up living there for 6 more months before leaving and didn't pay a dime.

Joseph t I'm by no means a lawyer or judge and don't pretend to know what rental laws and agreements are. What I am is a realist and if you anger the landlord he will find a reason to evict you.

As a landlord I'd tell the tenants in so many words that their rent will go way up if they aggravate me.

Once again you show that you have no idea what you are talking about. First in order to evict them the landlord would have to Goto court, and no judge is going to evict them with the landlord breaking the law. Also, it is against the law for the landlord to retaliate against renter. Now the landlord could refuse to sign a new lease at the end of the old one but that is a different story.

I wasn't trying to make fun of you or demean that you rent at all but stating the facts that someone else owns the home and at the end of the day you can take to court and court says yes you can have whoever at the home you want. Landlord evicts you and you have no place to live. If you like the home, rent is within your range, don't poke the landlord threatening him. You will loose.

If you cant afford a 250k house you do live in the cheap slums. Had you purchased a home a year ago your payment would have been about 1054.00 a month and now the payment is 1640.00 a month. Rents have gone up accordingly. Dont blame the landlord blame Biden and the democrats.

Op don't worry about anyone else but yourself if renting is all you can afford so be it. My wife and I rented for years before we could afford to buy anything. Even then it wasn't as nice as the neighbors or our friends' places but it is paid for.
