I was confused on this. I thought this person had already been to court and was talking about a final decision

The judge will look at whatever is presented to him or her. At least anything relevant.

The LEO has to serve the papers. Does anyone know what a judge takes into consideration when deciding custody? Will the parents criminal record come into play? What if they do not have a DL and continue to get tickets for such? So many factors to take in to acount I just wonder what the judge really looks at?

gilreaths, check you PM.
No custody order is valid unless it has been served on you by an official. i.e. law enforcement officer.

Well I have no idea what someone is telling, but if you have been involved in family court, you or your attorney will be notified of the decision in writing. I'm sure courts can be slow with mailings at times.
