Ok, if you have a employees manual that covers drug testing, that is a different story. The employees manual is a contract between the employer and it's employees. This is covered under contract law. You might be right if that is what you are talking about.

Great, thank you for this current information. We will try to add this to the next manual as a footnote. Just as soon as discrimination lawsuits go out of style.

A company can drug test anyone they want to, anytime they want to. Random drug testing don't mean testing random people. It means drug test at random times. I have known individuals to be tested 3 or 4 times in just a few months of weeks. This has been in and out of court a thousand times and the final outcome is that a company can test their employees anytime they wish.

I am not going to argue with you but it appears you are confusing a random drug test with a reasonable suspicion drug test. Random test are computer generated, reasonable suspicion is selective testing for specific reasons.

An employer cannot require reasonable suspicion drug testing without meeting certain criteria. Reasonable suspicion referral must be based on a trained supervisor's (a) specific, (b) contemporaneous, (c) articulable observations based on the appearance, behavior, speech or body odor of the person for whom the referral is made. Rumors, or unsubstantiated conversation from an outside observers are not permitted.

Total bullshrt. A company can give drug test at random. They don't have to suspect a thing.

sometimes families do not have a choice...the condition of the patient will determine the need for 24 hour nursing services. its about what can be provided by nursing staff to your loved one! things that you cannot provide for them.

you can only stay vigil during the time your loved one is being cared for by others!

I don't think I could ever trust a nursing home.

Not sure that would have been legal. Since everyone was tested it could be. Certainly not ethical and appears to have been detrimental.

I remember once being called in to a previously unscheduled mandatory meeting. The meeting turned out to be a mass drug test of everyone in our department. The reason was that a "concerned " person had reported drug abuse by a coworker to management. When the results came back, the accused individual was clean. Another coworker with an otherwise spotless record was found to have THC in their urine and lost their job.

Who benefitted?

Sure it was.

Never mind that for drug tests they take into account what prescriptions you are taking.

No but it was because of my prescription !
