RESTRAINING ORDER OR TRESPASSING I

He stole money from **** and he stole all her kitchen appliances for drug money. I left everything in the trailer and I am sure he is stealing stuff everyday I thought he has changed. She said he was going to Church. That is a joke. Maybe is planning on robbing the Church.

There are usually eight or more cars and men here at the trailer and today the traffiic has been zero.

**** said she knew it was ****. He hangs out at the trailer during the day and eats good meals that **** cooks and brings his girlfriend and I am going to stop that. I told him he would have to eat out all the time and miss her good cooking. I don't want to charge him from stealing because he will do it again and again. I want him away from **** and kids. She is trying to give those kids a goood life and **** thinks of no one but himself. That is why I want a restraining order. I told **** she could go to his room he rents and visit wtih her son but not in the trailer. He has never apologed for the money he stole from last Dec.

He is charming. Can talk about religion, the sky, and local interest. He is considerate and thoughtful and very nice. He is nothing but a con artist at his age.

He doesn't work but day a week he is helping his girfriend step Dad who had a stroke. I told ****, I am sure he will steal from him. He has a room. Does not have enough money for an apt, electric bill and etc so he hangs out with ****. No anymore.

**** has told me for about a year that she believes he will wind up in jail. I told her I thought a prision time might be good for him. If someone doesn't shoot him first.

A restraining order is an order from the court for one person (the defendant) to stay at least a set distance away from another person (the plaintiff).The restraining order might also order the defendant to have no contact with the plaintiff, and in certain domestic situations, the restraining order might order the defendant to either vacate the family home or allow the plaintiff to vacate the family home (temporarily.)In most cases, unless the defendant and plaintiff fall into the narrow grouping of “domestic relations,” an attorney prepares and files the restraining order.

Trespassing is a crime that any person who has standing can have prosecuted through the criminal court system.

Unfortunately, neither process keeps a defendant from continuing the behavior.Domestic related restraining orders have statutory arrest clauses built in to them, however, most others do not.A defendant can be charged with violating the conditions of his or her release if they have been ordered by the court (usually a magistrate) to stay away from the complainant as part of their release conditions after they have been charged with the crime of trespassing and they refuse to comply.

All restraining orders are filed with the Clerk of Court’s Office (at least here in Wilkes) but the Magistrate’s Office is available should a person decide to pursue criminal charges.

As with most things the devil is in the details.

A restraining order will keep him 500 ft away from you and should also keep him off your property a few yrs back a restraining order would cost you $100. If he stealing from you just call the law.

Still don't the answer. Can a restraining order keep-a certain person away from my property. He is not walking on it he is stealing. Big difference.

If he's around on your property during the day, shoot him in the kneecap. If he comes around after dark....shoot to kill

can't offer much advice here Quack...I've not yet been subjected to one....



call the sheriffs department...they should be able to tell you what you can and cannot do...good luck!

What is the difference between a restraining order or trespassing?

I know that most restraining order is issued because of danger, harassment, stalking but can a person get a restraining order to keep someone off my property, land and trailer. No job since last Dec. He has to steal all the time so he doesn't have to get a job. He is a Con Artist. A Drug addict.

Stealing to feed his drug habit. I do not want him around here at all. What are my options?
